1. Scope of application

• These General Terms and Conditions apply to all deliveries and services provided by Innoisolation e.U., both in the B2C and B2B sectors.

• Any deviating terms and conditions of the customer shall only apply if they have been confirmed in writing.

2. Conclusion of contract

​

• A contract is concluded as soon as the customer places an order and this is confirmed by Innoisolation e.U. in writing or by sending the goods..

• Prices and offers are non-binding and subject to change. Errors and technical changes reserved.

• The contract is concluded between the customer and MIGmbH. All payments are made directly to MIGmbH, and delivery is carried out by MIGmbH.

3. Prices and payment

​

• All prices are net plus statutory sales tax (B2B) or gross (B2C).

• Payment is made in advance or by credit card.

4. Delivery and shipping costs

​

• The delivery time will be agreed individually or specified in the order confirmation.

• Shipping costs will be shown separately and are to be borne by the customer.

• Partial deliveries are permitted, provided they are reasonable for the customer.

5. Retention of title

​

• The goods remain the property of MIGmbh until full payment has been received.

• In the B2B sector, the company retains ownership until all claims arising from the current business relationship have been settled.

6. Right of withdrawal

​

• The right of withdrawal within 14 days only applies to white (unopened) paint; all other colors are custom-made and are excluded from exchange and withdrawal rights.

• To exercise the right of withdrawal, the customer must send a clear statement (e.g., by email) to Innoisolation e.U.

• Returns - The customer is responsible for the return shipping costs.

7. Warranty and liability

• The statutory warranty provisions apply.

• In B2B business, MIGmbH is liable for defects at its discretion either by repair or replacement. Further claims are excluded.

• Liability for negligence is excluded.

8. Data protection

​

• Customer data is processed in accordance with the applicable data protection regulations and is used solely for order processing and customer service purposes.

9. Final provisions

​​

• The law of the Republic of Austria applies.

• The place of jurisdiction for all disputes is the registered office of the company, provided that the dispute relates to B2B transactions.
